PHC Activates Committee to Purge Corrupt Judiciary – Pakistan

Peshawar: The Peshawar High Court has decided to activate an existing committee chaired by Senior Justice Puisne to eliminate corruption and malfeasance, in addition to its bench, regional judiciary and high courts.

The decision was taken at the recent Heroes of the Court’s full court judges meeting, chaired by PHC Chief Justice Sm Attique Shah.

The meeting thread discussed several key points on the agenda, including contempt for court cases before the High Court; delaying submission of comments in cases; mechanisms for eliminating corruption for PHC staff and regional attorney general staff; services for appointing staff of the High Court and regional judicial personnel; cases management at the PHC level; policies for official visits and seminars; rules for preparation of independent service for regional and regional judiciary agencies; and services for notification, etc.

With unanimous approval, the Chief Justice of the PHC ordered the activation of a committee chaired by Puisne Senior Justice Ijaz Anwar to clear the corruption in the district justice and the High Court.

The Chief Justice of the PHC also directed two other judges, Waqar Ahmad and Justice Mohammad Fnoem Wali, to ensure that the distribution and fixation of cases are automatically driven within two months and to be fixed before the principles in judicial and judicial judicial justice in the High Court.

The Chief Justice of the PHC observed that the court’s proceedings are sacred and that every government agency, department or agency must comply with judicial instructions and must be free of delays where comments are sought.

It was decided that Khyber Pakhtunkwa advocates should serve as additional advocates for each bench to ensure that comments are presented without delay and comments are submitted quickly.

Regarding the adjournment of the case, the meeting decided that under no circumstances should the adjournment of the old case be adjournment. “If a lawyer is absent, a written argument should be obtained and repaired for the order after hearing the attorney at the court to ensure a prompt disposal.”

The meeting also discussed fixed issues regarding contempt cases.

The meeting decided that the despise court petition should be repaired first before the single-piece bed for a preliminary examination and if it is found that the matter is worth further, it can be placed before proper jurisdiction, whether single-button surgery.

It decided that the single benchmark for initial awareness of such matters should be the senior judge.

Policy regarding official visits and seminars that can be resolved should be placed before the Administrative Committee.

Decision PHC Registration Officers should visit the National Institute of Public Administration (NIPA) and other colleges/colleges to check their syllabus and course content and recommend how to align with the training provided by the KP Trial College.

The Chief Justice of the PHC also directed that the draft KP judicial services that have been under trial since 2018 should be carried out with the provincial government as soon as possible.

Regarding the expansion of jurisdiction of the judicial services tribunal under KP to deal with staff and officials of the district judicial personnel, he observed that the draft was placed before the Rules Committee. He expects to arrive at the legal department as early as possible.
