Peshawar: Peshawar High Court has ceased Deportation An Afghan refugee married a Pakistani woman and directed the national database and registration authorities to decide on cases regarding the Pakistan Origin Card issue (POC).
A bench composed of Wiqar Ahmad and Justice Kamran Hayat Miankhel disposed of the petition filed by the National People of Pakistan, Ms. Hasner and her Afghan husband, Masood Khan, seeking the government’s order to issue him POC.
The judge ruled: “Because the second petitioner was a family member of the Pakistani national, he was not deported until Nadella decided to grant him the POC case.”
The bench also directed the petitioner to apply for registration of his Nikanama, whose secretary should issue the above certification to verify that Nikana has actually happened, and that Nikanama is more than paper pork.

It was mentioned on the bench Earlier judgment In the High Court awarded on 1 December 2023, the judgment has been ruled in that judgment, which has been ruled by the court, in which the process and method of granting such citizenship and issuing POCs are clearly explained.
Currently, several Afghan nationals are married to Pakistani women and have children who apply for POC after being continuously deported from Afghan refugees (Afghan citizenship card) and POR (certificate of registration).
The High Court was also occupied by many petitions filed by Pakistani women seeking POC for an Afghan husband, who is a permanent residence document for Pakistan.
Saifullah Muhib Kakakhel and Nauman Muhib Kakakhel appeared among the petitioners and said the couple also had two children separated from the wedding.
They believe that the Afghan husband of a Pakistani petitioned woman has the right to obtain a POC under the law because it is constitutionally guaranteed the right to live a family under articles 4, 9, 14 and 25 of the Pakistan Constitution.
They further said that this marriage led to unquestioned children of Pakistani citizens born under Article 4 of the Pakistan Citizenship Act of 1951 and that the state was under constitutional and international bonds.
They believe that law enforcement agencies began mass deportation of Afghan refugees after their refugee status expired, and that the ACC/POR card is no longer considered a legal document left in Pakistan.
In this case, they said that despite being married to a Pakistani citizen and having children, the Afghan husband was deported and harassed despite being eligible for the POC, and that the application for the POC is still pending because of the longer and heavy safety clearance clearance clearance clearance clearance clearance clearance clearance clearance clearance clearance clearance clearance clearance clearance clearance clearance clearance clearance clearance. process.
The lawyer also referred to international human rights law, considering Pakistan a signatory to international conventions, such as the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, and therefore has an obligation to ensure that families are not destroyed arbitrarily.
They say that Afghan husbands and Pakistani children who expel Pakistani women were violated by these basic rights.
