Islamabad: Chief Justice of the High Court of Islamabad (IHC) Justice Sardar Mohammad Sarfraz Dogar is regarded as a member of the Supreme Judicial Commission (SJC), a top forum for judicial responsibility because SJC Will Will Will measure Next month, a complaint against a high court judge, including the IHC, is reviewed.
Under Article 209 of the Constitution, the SJC is composed of the Chief Justice of Pakistan, two senior Supreme Court judges and the senior High Court chief judges.
CJP Yahya Afridi is in charge of the forum, while Justice Mansoor Ali Shah and Justice Munib Akhtar represent the Supreme Court. Among the Chief Justices, LHC Chief Justice Alia Neelum is already a member, and the seats evacuated by SHC Chief Justice Junaid Ghaffar after retirement have now been filled by Dogar Judicial Justice, who ranks the highest in the High Court.
The Constitution says senior judges of the High Court are determined by the date of appointment as permanent chief judge and if in the case of tie they are appointed earlier as any High Court judge. It further stipulates that if a member is unable to act due to illness or conflict, the next senior judge or chief justice will automatically replace him.
The majority of the Council’s opinions prevail in all inquiries and if the judge is sister to misconduct or incapacity, it can be initiated by the President or the SJC itself. Unless through this process,
