A Counter-Terrorism Court (ATC) in Rawalpindi dismissed PTI’s plea on Friday, which brought a decision to bring the incarcerated founder Imran Khan to a trial procedure (GHQ) attack case through a video link.
Imran was arrested on May 9, 2023, sparking violent protests across the country, during which state buildings and military facilities, including GHQ, were burned and destroyed.
He is expected to attend the hearing held at ATC today via video link, but his lawyers objected to the arrangement for the PTI application before Judge Amjad Ali Shah.
Prosecutor Zaheer Shahs believes that the trial process is transferred from the Adiala Laber to the ATC of the Adiala Prison from the executive order of the Punjab government. He added: “There is a right to review executive orders with the Constitutional Court.”
He further argued that in 2016, the Criminal Procedure Code was amended to allow sisters to appear in court through video links.
Shah also listed articles 15 and 21 of the Counter-Terrorism Act, saying they authorized the court to make “decisions on trials.” He added that the government had “no obligation” to make reasons for transferring the trial.
The prosecutor said the application against Imran appeared was submitted via video link: “involving the difference in the cause of obstacles in trials and wasting time”. He said it was the right of a defense attorney, and that the higher court would object to the notice of transferring the trial from prison to the ATC, but could not stop the trial.
“We ask the court to conduct a fair trial,” said Faisal Malik, an attorney for Imran in his argument, adding that the fair trial was caused by the defendant in court.
He informed the ATC that they received a copy of the provincial government notice yesterday and they will object with the High Court.
The judge then asked Malik if he wanted to make more arguments about the matter.
