Quetta: A judicial court in the High Court of Bal Road, including Chief Justice Rozi Khan Bareach and Judge Sardar Ahmed Halimi, announced on Monday that it had accepted a constitutional petition to accept the ongoing repatriation of Afghan refugees and convened and articulated refugees.
A request from advocate Syed Nazir Agha calls for a six-month suspension. He appeared in front of the bench along with other Attorney General Muhammad Farid Dogar and assistant advocate Zahoor Ahmed Baloch.
Advocate Agha argues that thousands of Afghan children are recruiting schools and universities in Bal Luzhi Province, with only a few months left before the annual exam. Forced them to return at this stage, he said, would lose risk of damaging their education and property belonging to many refugee families.
He further insisted that Afghans who marry Pakistani nationals have the right to obtain citizenship under the Pakistan Citizenship Act of 1951. He curbed the deportation of refugees, which violated Articles 2A, 9, 25 and 25A of the Constitution. He urged the court to restrict the authorities and issue appropriate instructions.
After hearing the preliminary debate, the bench acknowledged the petition and issued a notice to the respondents and directed them to submit a written reply at the next hearing.
The petition includes the Chief Secretary of Bal Lu Chin, the Federal Home Secretary, the Secretary of the State and Border Regions, the Commissioner of Quetta, the IGP of Bal Lu Chin, and Levies Force DG as respondents.
