Five judges of the Islamabad High Court (IHC) – namely Justice Mohsin Akhtar Kayani, Babar Sattar, Tariq Mahmood Jahangiri, Saman Rifat and Arbab Tahir – filed a separate petition in the Supreme Court (SC) on Friday.
So far, dawn.com Only Legs were able to obtain a copy of Justice Kenny’s petition, and the contents of other requests had not been confirmed.
Judge Kayani in the petition asked the SC to declare executive powers that cannot be used to undermine the power of judges, and that the Chief Justice of the High Court has no authority to form a bench or withdraw the judge from the roster at will.
It also urged the SC to announce that “the constitution, transfer of cases and issuance of the lineup can be completed only in accordance with the rules adopted in Article 202 (Rules of Procedure)”.
The petition also requires the Supreme Court to announce the formation of the bench, and the responsibility for issuing lineups and transfer cases cannot be solely in the hands of the Chief Justice.
